Property Litigation

1MCB's Property Litigation Team provides expert professional advice and representation in relation to a wide range of property disputes. Our members regularly appear in the High Court, County Courts and before a variety of specialist tribunals.

Particular areas of interest for the Property Litigation Team are:

Commercial and Residential Landlord and Tenant: possession & forfeiture claims, assignments, renewals, enfranchisement, dilapidations & repairs, breach of covenant, rent and service charge recovery

Chancery: mortgages and charges, business sales, insolvency, probate and trusts (including TOLATA 1996 claims), undue influence, rectification, estoppel and other matters in equity

Land: trespass, nuisance, title and boundary disputes, licences, land registration, easements and profits a prendre

Construction Disputes: negligence and breach of contract (including JCT) by contractors and trades people, project management failures

Members of the Property Litigation Team are also available to advise on questions of professional competence (including disciplinary issues) arising from property work such as conveyancing, surveying, construction or repairs.
